To enter, complete and submit an official entry form (while supplies last) or hand-print your name, address, daytime and evening telephone numbers and date of birth on a plain 3"x 5" card and deposit it into the drop box at one of the eleven participating Nextel Preferred Partners in the Chicagoland area (Advanced Communications, Air 1 Wireless, DuPage Cellular, Prime Wireless, Pronto Communications, Radioman Communications, Superior Wireless Communications, TNT Wireless, Tri-Corp Wireless, Vazcom Communications, Wireless Group, World Wide Wireless), or mail entry to "2004 Nextel Chicago Cubs Ernie Banks" Sweepstakes, c/o Octagon, 1266 East Main Streer, 7th Floor, Stamford, CT 06902, Attn: Josh Ellovich. Limit one entry per person. No reproductions, facsimiles, photocopied, altered, forged, damaged, illegible or incomplete entries accepted, and all such entries are ineligible. All entries must be received by 11:59pm EDT on June 10, 2004. Entries will become the property of Companies and will not be returned. Nextel Operations, Inc., a Delaware corporation, d/b/a Nextel Communications (Sponsor), Octagon, Inc., TBWA Chiat / Day, NPS LLC, Chicago National League Ball Club, Inc., and each of their respective shareholders, employees, officers, affiliates, representatives, agents, successors, and their related companies, agencies, governors, distributors, sponsors and all prize suppliers/participants (collectively, the "Companies") are not responsible for lost, damaged, stolen, late or misdirected entries or for any errors associated with the sweepstakes, including entries that are not received by Octagon by 11:59pm EDT June 10, 2004, and all such entries are ineligible. By entering, entrants agree that information provided upon entry can be shared with promotional partners, retailers, vendors and other companies without further notice or compensation.


Prizes will be awarded via a random drawing conducted on or about June 11, 2004 from all eligible entries received by an independent judging organization whose decisions are final on all sweepstakes matters. Odds of winning are one in ten-thousand.

Grand Prize: One (1) grand prize winner will receive Two (2) Ernie Banks autographed Baseballs, two (2) VIP passes (for winner and their child) to have batting practice at Wrigley Field coached by Ernie Banks prior to the Chicago Cubs game at Wrigley Field on June 20, 2004 (the "Game"), and two (2) tickets to the Game. Total approximate retail value ("ARV") of the Grand Prize is $499. Potential winner must be available to attend the Game on June 20 (or rain date if Game is cancelled in accordance with Major League Baseball rules), or the prize will be forfeited and an alternate winner will be selected. Game tickets and location of seats subject to availability. Winner will be solely responsible for travel to and from the Game and all expenses incurred while at the Game. All taxes, charges and other expenses not expressly listed in these rules as being part of the prizes are the sole responsibility of the winner. If Ernie Banks is not available for any reason, then another current or former professional baseball player will be selected to participate in the prize. Winner will be notified by telephone on or after June 11, 2004. If the winner cannot be reached by telephone within 48 hours of the drawing or is ineligible, the prize will be forfeited and an alternate winner selected. Winner will be required to sign and return an affidavit of eligibility, prize acceptance form and applicable tax documentation ("Prize Documentation"). Sponsor will fax affidavit and documentation to winner during the week of June 11. Winner must return signed affidavit and documentation within five (5) days of receipt. The Grand Prize will be awarded after receipt of the affidavit and documentation. If the Prize Documentation is returned as undeliverable, or is not returned within five (5) days of receipt, the prize will be forfeited and an alternate winner selected.

Open to all legal residents of Illinois, Michigan, Wisconsin, Indiana, Ohio and Iowa who are at least 18 years of age at the time of entry, with the guest being nine (9) years or older. If guest is under 18 years old, Winner must be parent and legal guardian of guest. Void where prohibited or restricted. Offer subject to all applicable laws. Employees of the Companies and members of their immediate families and households of each are not eligible to participate.


By participating, entrants agree (a) to abide by these Official Rules and the decisions of Companies and judges, which will be binding and final in all respects; (b) to Companies' use of information supplied by entrants for advertising purposes as allowed by law; (c) to indemnify, defend and hold harmless Companies, their officers and employees from all liability, claims, law suits, costs, expenses, fees, injuries, (including death), losses, and damages resulting from participation in the sweepstakes, acceptance or use of the Prize, and/or from entrant's fraudulent or wrongful acts or omissions; (d) not to sue Companies for any damages arising from winner's acceptance of or use of the Prize; and (e) to allow Companies to use winner and guest name, voice, biography and likeness without further notice or compensation for promotion, advertising, filing and dissemination purposes, except where it is prohibited by law. Sponsor and Promoter shall have the sole right to disqualify any contestant for violation of these rules or any applicable laws relating to the sweepstakes, and to resolve all disputes in their sole discretion. Companies (i) make no warranty, guaranty or representation of any kind concerning the prize, (ii) disclaim any implied warranty and (iii) are not liable for injuries, losses or damages arising out of any person's participation in the sweepstakes or the acceptance and use of any prize and travel. All disputes will be resolved under applicable U.S. laws. Prizes are not transferable. No substitutions or cash equivalents will be allowed except at the sole discretion of the Companies. If the prize or any portion thereof becomes unavailable for any reason, Companies reserve the right to substitute a prize or item of equal or greater value.

Companies reserve the right to cancel or suspend the Sweepstakes for any reason. In the event of cancellation, Nextel Communications, Inc. may elect to identify winners and award the prizes by way of random drawing from among all entrants who had entered the sweepstakes up to the time and date of such cancellations.

Companies are not responsible for late, lost, damaged, misdirected, incorrectly addressed, incomplete, illegible, undeliverable or destroyed entries resulting from any reason, including but not limited to: any hardware or software failures of any kind; lost or unavailable network connections; failed, incomplete or garbled computer or telephone transmissions; typographical or system errors; problems or technical malfunctions of any telephone network or lines, computer online systems, servers, providers or computer equipment; or technical problems or traffic congestion on the Internet, at a Website, or any combination thereof. Companies are also not responsible for any injury or damage to entrant's or any other person's computer related to or resulting from playing the Sweepstakes, or downloading any material for the Sweepstakes which may limit an entrant's ability to participate. Companies may prohibit anyone from participating in the Sweepstakes or winning a prize, if in their sole discretion they determine they are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other players or Companies representatives. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES ADMINISTRATOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
